Terms and Conditions


Plush Hotel provides various Services available to visitors located throughout the world. Our websites and apps include without limitation, this website (“Site”). Our Site is controlled and operated from Nigeria and is subject to Nigerian Law.

The content and information displayed on the Site is Plush Hotel’s property and is collectively referred to as “Plush Hotel Information”. The downloading, reproduction, or re-transmission of Plush Hotel Information, other than for non-commercial individual use, is strictly prohibited, except to the extent permitted with prior written consent by Plush Hotel.


In these Terms of Use, unless the context otherwise requires, the following expressions have the following meanings:

“Applicable Law”

means the Constitution of the Federal Republic of Nigeria, any national, provincial, state or local law, statute, bye-law, ordinance, decree, directive, regulation, standard, circular, guideline, rule, code, delegated or subordinated legislation, judicial act or decision, judgment, order, proclamation, directive, executive order, other legislative measure, binding actions or enactments of the Federal Republic of Nigeria or any other government authority in Nigeria;


means the Site, and the information, writings, images and/or other works that the user sees, hears or otherwise experiences on the Site;

“Intellectual Property Rights”

means the patents, rights to inventions and discoveries, utility models, copyright, trademarks, service marks, trade, business and domain names, rights in trade dress or get-up, rights in goodwill or to sue for passing off, rights in designs, rights in computer software, database rights, moral rights, rights in confidential or proprietary information, (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications for and renewals or extensions of such rights, and all similar or equivalent rights or forms of protection in any part of the world belonging to Plush Hotel or its affiliates;


shall have the meaning given under “User Information and Materials”;

Personal Data”

means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person; It can be anything from a name, address, a photo, an email address, bank details, posts on social networking websites, medical information, and other unique identifier such as but not limited to MAC address, IP address, IMEI number, IMSI number, SIM, Personal Identifiable Information (PII) and others;

“Plush Hotel”

means Plush Hotel situate at 5 Mbala Street, Zone 4, Wuse Abuja;


means the Privacy Policy under the Terms of Use; and


means websites and apps.

User Accounts

To use the Site, you must register and create an account (“Account”) and to be eligible to create an Account, you must be at least 18 years old.

When you set up your Account, you will be required to create log-in credentials by providing certain types of personal information (“Login Credentials”).

In registering for the Services, you agree to provide true, accurate, current and complete information about yourself as prompted by the Site’s registration form (“Registration Data”); and to maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

You are responsible for maintaining the confidentiality of your Login Credentials and are solely responsible for all activities that occur using your Login Credentials. You agree not to allow a third party to use your Login Credentials at any time.

Plush Hotel reserves the right to terminate any username and password which it reasonably determines may have been used by an unauthorized third party. You agree not to create an Account using false identity or information, or on behalf of someone other than yourself.

Use of Site

The services on the Site are available only to individuals who can form legally binding contracts under applicable law, and thus, are not available to minors. By using the Site, you represent that you are of sufficient legal age to use the Site and to create binding legal obligations for any liability you may incur as a result of the use of the Site. You also warrant that you are legally authorized to make the travel reservations and purchases for either yourself or for another person for whom you are authorized to act.

The Site is to be used by you for your personal use only. You agree that you will not use the Site for chain letters, junk mail, "spamming", solicitations (commercial or non-commercial) or bulk communications of any kind including but not limited to distribution lists to any person who has not given specific permission to be included in such a list. In addition, you agree not to create a hypertext link from any web site controlled by you or otherwise, to the Site without the express written permission of Plush Hotel. You agree not to pretend to be any other person or a representative of any entity, whether actual or fictitious, including an employee or agent of Plush Hotel or any third party that provides services related to the Site. By using the Site, you agree to provide true, accurate, current and complete information about yourself.

You further represent and warrant that you are who you say you are, that you have not submitted fictitious, false or inaccurate information about yourself, and that all information contained in the posted Materials is true and your own work or work you are authorized to submit, and that the posted materials do not contain any threatening, harassing, libelous, false, defamatory, offensive, obscene, or pornographic, material, or other material that would violate any Applicable Law or regulation. You agree that you will not knowingly and with intent to defraud provide material and misleading information.

Prohibited Uses

You may use the Site only for lawful purposes and in accordance with these Terms of Use.

You agree not to use the Site:

  • in any way that violates any Applicable Law;


  • for the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise;


  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with these Terms of Use;


  • to transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam” or any other similar solicitation;


  • to impersonate or attempt to impersonate Plush Hotel, an employee of Plush Hotel, another user or any other person or entity (including, without limitation, by using e-mail addresses or user names associated with any of the foregoing);


  • to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by Plush Hotel, may harm the Plush Hotel or users of the Site or expose them to liability;


  • to use the Site in any manner that could disable, overburden, damage or impair the Site or interfere with any other party’s use of the Site, including their ability to engage in real time activities through the Site;


  • to use any robot, spider or other automatic device, process or means to access the Site for any purpose, including monitoring or copying any of the material on the Site;


  • to use any manual process to monitor or copy any of the material on the Site or for any other unauthorized purpose without our prior written consent;


  • to use any device, software or routine that interferes with the proper working of the Site;


  • to introduce any viruses, trojan horses, worms, logic bombs or other material which is malicious or technologically harmful;


  • to attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer or database connected to the Site;


  • to attack the Site via a denial-of-service attack or a distributed denial-of-service attack; or


  • to otherwise attempt to interfere with the proper working of the Site.


You consent to conduct electronic transactions and receive electronic communications through the Site. This includes your consent to send and receive documents electronically and conduct business and complete transactions electronically. You understand that you are not required to give legal consent, however, if you decline, Plush Hotels reserves the right to deny you access and use of the Site.

You consent to the verification and authentication of your identity using third-party services where applicable. These methods may include using the information, databases, audio and video conferencing technology, SMS text or email verification, credit reports, or other third party or other information available to Plush Hotel or by third parties using any identify proofing methods, such as forensics, knowledge-based questions, biometrics, in any combination of hardware and software.

You grant permission to Plush Hotel to use your name and/or logo as part of its marketing and promotional efforts.

User Information and Materials

You represent that you have all right title, and interest to materials you post on the Site or Documents you provide to Plush Hotel ("Materials"), including but not limited to any consent, authorization, release, clearance or license from any third party (such as, but not limited to, any release related to rights of privacy or publicity) necessary for you to provide, post, upload, input or submit the Materials, and that posting such Materials does not violate or constitute the infringement of any patent, copyright, trademark, trade secret, right of privacy, right of publicity, moral rights, or other Intellectual Property Right recognized by any applicable jurisdiction of any person or entity, or otherwise constitute the breach of any agreement with any other person or entity.

You represent and warrant that the Materials you supply do not violate these Terms of Use.

Chat Area

"Chat Area" means any chat area, forum, message board, or similar service offered in conjunction with the Site. If You participate in a Chat Area, you agree that, in addition to complying with the Terms and Conditions, you will not: defame, abuse, harass, threaten, or make any discriminatory statements about others; advocate illegal activity; use indecent, obscene or discourteous language or images; or provide content that is not related to the designated topic or theme of the Chat Area. You shall remain solely responsible and liable for your use of the Chat Area. Plush Hotel reserves the right to remove or edit content from any Chat Area at any time and for any reason, however, Plush Hotel has no duty to do so, and is not responsible for the content or accuracy of any information in a Chat Area.

We reserve the right, at our discretion, to change and or modify portions of these Terms and Conditions at any time without notice and, unless otherwise indicated, such changes will become effective immediately upon posting; therefore, please check these Terms and Conditions periodically for changes. We will display the effective date of these Terms and Conditions at the top of this page.

User Feedback

By submitting any ideas, comments, suggestions or other information: to a Chat Area; or to Plush Hotel related to improvements to the Sites or services related to the Sites; (collectively, the "Feedback"), You agree that such Feedback shall be deemed, and shall remain, Plush Hotel's property. None of the Feedback shall be subject to any obligation of confidentiality on Plush Hotel's part and Plush Hotel shall not be liable for any use or disclosure of any Feedback. Plush Hotel shall own all rights related to the Feedback (including without limitation intellectual property rights and moral rights) and shall be entitled to use of the Feedback without restriction for any purpose whatsoever, commercial or otherwise, without compensation to you.

Intellectual Property and other Rights

The Site is protected by applicable intellectual property and other laws, including trademark and copyrights laws and treaties. The Site, including all Intellectual Property Rights in the Site, including the Content, belongs to and is the property of Plush Hotel or its licensors (if any). Neither these Terms nor your access and use of the Site gives you any ownership rights or licenses to the Content.


Subject to the Terms herein, Plush Hotel grants you a limited, non-exclusive and non-transferable license to access and use the Site as expressly permitted in these Terms and any applicable paid user plan that enables registration of an Account for the use of the Site, when applicable.

The rights granted to you in the Terms are subject to the following restrictions:

  • you shall not license, sell, rent, lease, transfer, assign, reproduce, distribute, host or otherwise commercially exploit or create derivate works based on the Site, Content and back-end databases, (collectively, “Plush Hotel’s Properties”) or any portion of Plush Hotel’s Properties;


  • you shall not frame or utilize framing techniques to enclose any trademark, logo, or other Plush Hotel’s Properties (including images, text, page layout or form) of Plush Hotel;


  • you shall not use any metatags or other hidden text using Plush Hotel’s name or trademarks;


  • you shall not modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of Plush Hotel’s Properties except to the extent the foregoing restrictions are expressly prohibited by Applicable Law;


  • access Plush Hotel’s Properties in order to build a similar or competitive website, application or service;


  • except as expressly stated herein, no part of Plush Hotel’s Properties may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means;


  • you shall not remove or destroy any copyright notices or other proprietary markings contained on or in Plush Hotel’s Properties; and


  • you shall not use Plush Hotel’s Properties for any illegal or unlawful purpose.

Any unauthorized use of Plush Hotel’s Properties may result in the immediate termination of your right to use the Site, as well as, potential liability for copyright infringement or other claims depending on the circumstances.


You agree that you will not use any device, software or other instrumentality to interfere or attempt to interfere with the proper working of our Sites, and that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. In addition, you agree that you will not use any robot, spider, other automatic device, or manual process to monitor, scrape, or copy our Sites or the Plush Hotel Information contained therein, or any aspect of the Sites or the Plush Hotel’s Information, without the prior express consent from an authorized Plush Hotel representative (such consent is deemed given for standard search engine technology employed by internet search websites to direct Internet users to our Site. You shall also not use any manual process to monitor or copy any of the material on the Site or for any other unauthorized purpose without our prior written consent of Plush Hotel.

Furthermore, you agree that you will not use our Sites for any purpose that is illegal, unlawful, or prohibited by these Terms and Conditions. You agree that You will not interrupt, disrupt, alter, destroy, impair, restrict tamper, or otherwise affect the proper operation of our Sites in any way, including, without limitation, through the use of any malicious or unauthorized code, virus, worm, Trojan horse, malware, or program.

You agree that Plush Hotel has no obligation to but may monitor and review information you transmit over the Site. You agree that Plush Hotel may censor, edit, remove or prohibit the transmission or receipt of any information that Plush Hotel deems inappropriate or in violation of these Terms and Conditions, and use any such information as necessary to provide the Sites or to protect the rights or properties of Plush. You agree that Plush Hotel may also monitor and review stored information without restriction. You hereby acknowledge and consent to such monitoring and reviewing.

You may not use our Site in any threatening, libellous, slanderous, defamatory, obscene, inflammatory, pornographic, discriminatory, or otherwise offensive manner. We reserve the right in our sole discretion to revoke or deny your access to our Site, including, without limitation, if you violate any of the provisions of these Terms and Conditions.

You agree that you will make only legitimate reservations in good faith for use by you and your invited guests only, and not for other purposes, including without limitation, reselling, impermissibly assigning or posting on third party websites, or making speculative, false or fraudulent reservations, or any reservation in anticipation of demand.

You also agree not to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by Plush Hotel, may harm the Plush Hotel or users of the Site or expose them to liability;


Plush Hotel makes no representations about the suitability, reliability, availability, timeliness, security or accuracy of the Site or its content for any purpose. To the maximum extent permitted by Applicable law, all such information, software, products, service and related graphics are provided "as is" without warranty or condition of any kind.

Plush Hotel hereby disclaims all warranties and conditions of any kind with regard to the Site and the content, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title and non-infringement.

This Privacy Statement describes the privacy practices of the Plush Hotel for data that we collect:

The Data We Collect

At touchpoints throughout your guest journey, we collect Personal Data in accordance with Nigerian law, and to serve you better. Personal Data includes information that may identify you as an individual or relate to you as an identifiable individual:

  •  Name

  •  Gender

  •  Postal address

  •  Telephone number

  •  Email address

  •  Credit and debit card number or other payment data

  •  Language preference

  •  Date and place of birth

  •  Nationality, passport, visa or other government-issued identification data

  •  Important dates: birthdays, anniversaries and special occasions

  •  Membership or loyalty program data (including co-branded payment cards, travel partner program affiliations)

  •  Employer details

  •  Travel itinerary, tour group, or activity data

  •  Prior guest stays or interactions, goods and services purchased, special service and amenity requests

  •  Social media account ID, profile photo and other data publicly available, or data made available by linking your social media and loyalty accounts

In more limited circumstances, we may also collect:

  • Data about family members and companions, names and ages of children

  • Biometric data

  • Financial information

  • Images and video and audio data via: (a) security cameras located in public areas, such as hallways and lobbies, in our properties; and (b) body-worn cameras carried by our security personnel

We may also collect information about your Preferences that we use to make your current and future stays and experience with us more enjoyable, including information about your interests and other relevant information about you that we learn about during your stay. This may also include any likes and dislikes about our services that you tell us about so that we can improve our services, and specific dietary or health restrictions to ensure your wellbeing. We may also collect your “Personal Preferences,” that may include details of your special anniversaries (such as your birthday or wedding anniversary), what type of activities you prefer to take part in when staying with us and your hobbies. Personal Preferences may also include details about who you usually travel with, their relationship to you and your marital status.

If you submit any Personal Data about other people to us or our Service Providers (e.g., if you make a reservation for another individual), you represent that you have the authority to do so and you permit us to use the data in accordance with this Privacy Statement.

Cookies And Other Data

We may also collect “Other Data” that generally do not reveal your specific identity or do not directly relate to an individual. To the extent Other Data reveal your specific identity or relate to an individual, we will treat Other Data as Personal Data. Other Data include:

  • Your browser or device. We collect certain data through your browser or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, internet browser type and version and the name and version of the Online Services (such as the Apps) you are using. We use this data to ensure that the Online Services function properly.

Pixel Tags and other similar technologies


We collect data from pixel tags (also known as web beacons and clear GIFs), which are used with some Online Services to, among other things, track the actions of users of the Online Services (including email recipients), measure the success of our marketing campaigns and compile statistics about usage of the Online Services.

Adobe Flash technology (such as Flash Local Shared Objects (“Flash LSOs”) and other similar technologies


We collect data through Flash LSOs and other technologies on some Websites to, among other things, collect and store data about your use of the Online Services. Your IP Address


We collect your IP address, a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). An IP address is identified and logged automatically in our server log files when a user accesses the Online Services, along with the time of the visit and the pages that were visited. We use IP addresses to calculate usage levels, diagnose server problems and administer the Online Services. We also may derive your approximate location from your IP address.


Aggregated And Segmented Data


We may aggregate data that we collected and this aggregated data will not personally identify you or any other user. We may also use both Personal Data and Other Data to divide customers into segments, or groups, in order to provide more relevant advertising.


Location-Based Services


We may collect the precise physical location of your device by using satellite, cell phone tower, WiFi signals, or other technologies. We will collect this data if you opt-in through any other program (either during your initial login or later) to improve special offers and to enable location-driven capabilities on your mobile device. If you have opted-in to share your location, or other program will continue to collect location data based on how you chose to share the data.

Location Opt-Out

The user can specify via the device’s operating system to always share location, only when the site is in use, or never. If you choose only when the site is in use, we will have access to the data until you log off or close the application or if you use your phone’s or other device’s settings to disable location.

We collect Personal Data or Other Data when you interact with our Online Services, by performing such actions as, but not limited to, browsing, making a reservation, purchasing goods and services from our websites or Apps, communicating with us or otherwise connecting with us or post to social media pages, or signing up for a newsletter or participating in a survey, contest or promotional offer.


  • Property Visits and Offline Interactions. We collect Personal Data when you visit our properties, or use on-property services and outlets, restaurants, concierge services, health clubs, child care services and spas. We also collect Personal Data when you attend promotional events that we host, sponsor, or in which we participate, or when you provide your Personal Data to facilitate an event.


  • Customer Care Centres. We collect Personal Data when you make a reservation over the phone, communicate with us by email, fax or via online chat services or contact customer service. These communications may be recorded for purposes of quality assurance and training.


  • Authorized Licensees. We collect Personal Data from companies when we enter into a license or similar agreement to sell goods and services.


  • Strategic Business Partners. We collect Personal Data from companies with whom we partner with to provide you with goods, services, or offers based upon your experiences at our properties or Homes and Villas, or that we believe will be of interest to you (“Strategic Business Partners”).


  • Other Sources. We collect Personal Data from public databases, joint marketing partners and other third parties.


  • Internet-Connected Devices. We collect Personal Data and Other Data from internet-connected devices available in our properties. For example, when you connect a device to the hotel’s internet, a smart home assistant may be available for your use to tailor your accommodations and experience.

We use your Personal Data for, verification of your identity; human resources management; access to computer systems and third party software; know-your-customer and due diligence purposes; recruitment purposes; regulatory compliance; performance of a contract with you; compliance with legal obligation; marketing; litigation; events planning and hosting; in-house security; research, analysis, and other business purposes or legitimate interests.

Consent and Access Right

We will obtain your consent prior to collecting or processing your Personal Data. Where we intend to use the information for a purpose other than the purpose for which it was collected, prior to such use, we will request your consent.

No consent shall be sought, given or accepted in any circumstance that may engender direct or indirect propagation of atrocities, hate, child rights violation, criminal acts and anti-social conducts.

You may withdraw your consent at any time and may request access to your Personal Data in our possession. Such withdrawal will not affect the lawfulness of the processing of your Personal Data prior to the withdrawal of your consent. We can, however, deny you access to the information where we determine that your request is unreasonable.

You have the right to request the modification or amendment of your Personal Data in our possession.

In all cases of access or request for modification or amendment of Personal Data, we shall request sufficient identification to enable us to confirm that you are the owner of the data sought to be accessed, modified or amended.

Where you provide the Personal Data of a third party to us, you confirm to us that you have informed the owner of the data about the purpose for which the data is required and that you have obtained the consent of the owner of the data to provide the data to us for the purpose for which it is required and in accordance with this Privacy Policy.

Personal Data Protection Principles

When we process Personal Data, we are guided by the following principles. Personal Data shall be:

  • collected only for specific, legitimate and lawful purposes;


  • processed lawfully for the purpose for which it was collected and not further processed in a manner incompatible with which that purpose(s);


  • processed adequately, accurately and without prejudice to the dignity of the human person;


  • adequate, relevant and limited to what is necessary in relation to the purpose for which it is processed;


  • accurate and where necessary, kept up to date;


  • stored only for the period within which it is reasonably needed; and


  • processed in a secure manner and protected against unauthorised or unlawful access or processing or accidental loss, destruction or damage.

Security Measures

Access by Third Parties

Transfer Of Personal Data Outside the Country


We may transfer Personal Data outside Nigeria in the following circumstances:


  • with your consent;

  • the transfer is necessary for the performance of a contract between you and Plush Hotel or the implementation of pre-contractual measures taken at your request;

  • the transfer is necessary for the conclusion or performance of a contract concluded in your interest between the Company and another natural or legal person;

  • the transfer is necessary for important reasons of public interest;

  • the transfer is necessary for the establishment, exercise, or defense of legal claims; or

  • the transfer is necessary in order to protect your vital interests; or of other persons, where you are physically or legally incapable of giving consent.


Upon the transfer of information outside Nigeria, some principles of data protection may be violated in the receiving country. By consenting to the processing of your Personal Data, you consent to the transfer of your Personal Data outside Nigeria.


Retention of Personal Data


We will only retain your Personal Data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you. Where information is kept for a longer period, such as in back up storage, or archives, such information would be safeguarded in accordance with this Privacy Policy.


To determine the appropriate retention period for Personal Data, we consider the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, reporting or other requirements.


Where any information retained is stored in an encrypted format, considerations must be taken for secure storage of the encryption keys. Encryption keys must be retained as long as the data that the keys decrypt is retained.


In some circumstances we will anonymize your Personal Data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may retain and use this information indefinitely without further notice to you.





We will take swift action to remedy any suspected breaches of Personal Data.


We will not be responsible for any breach of Personal Data which occurs as a result of:


  • an event which is beyond our control;

  • an act or threats of terrorism;

  • any act of God (including but not limited to fires, explosions, earthquakes, floods, epidemics, or pandemics) which compromises our data protection measures;

  • war, hostilities (whether war be declared or not), invasion, act of foreign enemies, requisition, or embargo, rebellion, revolution, insurrection, or military or usurped power, or civil war which compromises our data protection measures;

  • the transfer of your Personal Data to a third party on your instructions; or

  • the use of your Personal Data by a third party designated by you.


If you know or suspect that a breach of Personal Data has occurred, or a violation of this Privacy Policy has occurred, you should immediately contact the Data Protection Officer at the contact information provided above.

Violations of this Privacy Policy by employees may result in disciplinary action.


Your Legal Rights

You have the right to:

  • Request access to your Personal Data (commonly known as a "data subject access request"). This enables you to receive a copy of the Personal Data we hold about you and to check that we are lawfully processing it.


  • Request correction of the Personal Data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.


  • Request erasure of your Personal Data. This enables you to ask us to delete or remove Personal Data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Data where you have successfully exercised your right to object to processing, where we may have processed your information unlawfully or where we are required to erase your Personal Data to comply with local law.   • Request the transfer of your Personal Data to you or to a third party. We will provide to you, or a third party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.


  • Withdraw consent at any time where we are relying on consent to process your Personal Data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. You will not have to pay a fee to:

  • access your Personal Data;

  • change your Personal Data provided to us; or

  • to exercise any of the other rights.

Notwithstanding the above, we will charge a reasonable fee where:

  • any of your requests is clearly unfounded, repetitive, or excessive. Alternatively, we could refuse to comply with your request in these circumstances if any criminal or illegal activity is suspected.


  • you request to change your Personal Data in our possession more than three (3) times within a 12-month period.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally, it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.




Our Site may provide you with the ability to use usernames, passwords, or other codes or devices to gain access to certain portions of our Sites (“access codes”). Indemnification and Limitation of Liability

Except to the extent prohibited by any Applicable Law, you agree to defend, indemnify, and hold Plush Hotel, its subsidiaries, affiliated companies, licensors, employees, agents, and any third-party information providers, harmless, including costs and legal fees, from any claim or demand made by any third party due to or arising out of:

  • your use, misuse, or inability to use the Site or the Content,

  • your violation of these Terms, or

  • your violation of Applicable Laws.

To the maximum extent permitted by law, we, other members of our group of and affiliated companies and third parties connected to us hereby expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Sites or in connection with the use, inability to use, or results of the use of our Sites, any websites linked to them and any materials posted on them, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.



This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability that cannot be excluded or limited under applicable law.

You shall defend us against any demands, claims or actions brought against us or arising as a result of any breach or violation of these Terms and Conditions by you (“Claim”) and you shall indemnify and hold us harmless from and against any and all losses, damages, costs and expenses (including attorneys' fees) resulting from any such Claim. We have the right, at our expense, to assume exclusive defense against any Claim and all negotiations for settlement and you agree to cooperate with us in the defense of any such Claim, at our request.


With respect to all communications you make to us regarding Plush Hotel Information including but not limited to feedback, questions, comments, suggestions and the like: (a) you shall have no right of confidentiality in your communications and we shall have no obligation to protect your communications from disclosure; (b) we shall be free to reproduce, use, disclose and distribute your communications to others without limitation; and (c) we shall be free to use any ideas, concepts, know-how, content or techniques contained in your communications for any purpose whatsoever, including but not limited to the development, production and marketing of products and services that incorporate such information.

Inaccuracies and Errors

Plush Information may contain technical inaccuracies and typographical errors, including but not limited to inaccuracies relating to pricing or availability applicable to your transaction. Plush Hotel does not assume responsibility or liability for any such inaccuracies, errors or omissions, and shall have no obligation to honor reservations or information affected by such inaccuracies. Plush Hotel reserves the right to make changes, corrections, cancellations and/or improvements to Plush Hotel Information, and to the products and programs described in such information, at any time without notice, including after confirmation of a transaction.

Mis-Communications / Lost Transactions

Plush Hotel and any other providers of products or services related to the Sites are not responsible for communication malfunctions, failures, or difficulties, or lost, stolen, or misdirected, transmissions, messages or entries, or the security of any such communications. Further, Plush Hotel and any other providers of products or services related to the Sites are not responsible for incorrect or inaccurate entry information, whether caused by user(s) or by any of the equipment or programming associated with the Sites, or by any technical or human error that may occur in the processing of any information related to the Sites. Plush Hotel and any other providers of products or services related to the Sites may cancel or modify reservations where it appears that a user has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error.

You agree that neither Plush Hotel nor any other providers of products or services related to the Sites are responsible for any damages that may arise as a result of any travel or hotel arrangements or other orders you request or make on the Sites which are not processed or accepted for any reason.

Hotel Reservations General Terms

In addition to the other terms and conditions specified on the Site regarding our hotel, the following general terms and conditions apply to reservations booked on the Site:

Cancellation policies and other information about specific room reservations and properties may vary by Property and by the type of reservation. Individual rate rules, tax information, applicable charges and cancellation policies are displayed in the “Review Reservation Details,” “Summary of Charges” and “Hotel Cancellation Policy” sections on the room reservation page of the Site.

Plush Hotel reserves the right, at its sole discretion, to modify the Site, Content and these Terms or any additional terms and conditions that are relevant to the Site from time to time to reflect changes in the law or to the Services.

Plush Hotel will post the revised terms on the Site with a “Last Modification” date. Please review the Site on a regular basis to obtain timely notice of any revisions. If you continue to use the Site after the revisions take effect, you agree to be bound by the revised terms. If any provision or part-provision of this Terms is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this Clause shall not affect the validity and enforceability of the rest of this Terms.


Governing Law

These Terms and Conditions shall be governed by, construed and enforced in accordance with the laws of Nigeria, without regard to its conflicts of law rules. The exclusive jurisdiction for any dispute not covered by the terms of the Arbitration provision set forth in these Terms and Conditions may be filed only in the state or federal courts located in Lagos, Nigeria. The foregoing shall not apply to the extent that applicable law in your country of residence requires application of another law and/or jurisdiction and this cannot be excluded by contract.




Except with respect to any claim or dispute involving the ownership, validity or use of any Plush Hotel trademarks or service marks, any dispute arising out of or related to the Sites (including any claim that any provision of these Terms and Conditions are invalid, illegal, or otherwise voidable or void) will be submitted for and resolved by binding arbitration in accordance with the Arbitration and Conciliation Act in Nigeria. Plush Hotel shall have the right in a proper case to obtain temporary restraining orders, temporary or preliminary injunctive relief and/or declaratory relief (other than declarations with respect to the amount of money damages) from a court of competent jurisdiction.

Any dispute or claim arising out of or in connection with this Policy or its subject matter or formation (including non-contractual disputes or claims) shall be governed and construed in accordance with the laws of the Federal Republic of Nigeria.

Any dispute, difference or claim arising out of or in connection with this Agreement shall be resolved amicably by the parties within thirty (30) days through negotiations failing which the dispute shall be settled exclusively and finally by Mediation. There shall be a mediator appointed by the Director of the Lagos Multi-Door Courthouse who shall settle such dispute.

The existence of a mediation proceeding during the performance of the Agreement shall not suspend the contractual obligations of the Parties. The Parties agree that the decision of the mediator is final and that they shall be bound by same and keep the contents of the mediation proceedings strictly confidential.

The language of the mediation shall be English, the venue of the mediation shall be Lagos, Nigeria and the cost of the mediation proceedings shall be borne by the breaching party as determined by the appointed mediator.
